Terms of Sale

These Terms of Sale (hereinafter the “Terms”) govern the sale, by the Seller identified in article 2, of the paid “Boost” subscription to the Implikare digital service (hereinafter the “Service”), available at https://implikare.com. The Service consists in the supply of digital content not provided on a tangible medium, namely an online job-search assistance application.
Article 1
Purpose and scope
These Terms apply to any subscription to the paid “Boost” plan by a consumer within the meaning of the preliminary article of the French Consumer Code — namely any adult natural person acting for purposes outside their commercial, industrial, craft, liberal or agricultural activity.
These Terms do not apply to professional customers; any professional use shall be covered by a separate contract. Access to the free plan is outside the scope of these Terms, which govern exclusively the paid subscription.
Subscribing to Boost constitutes full acceptance of these Terms, which the Customer acknowledges having read prior to entering into the contract, via a non-pre-checked checkbox during the payment flow.

Article 3
Description of the Boost service
3.1 Scope of the subscription
The Boost subscription gives access, for each calendar month, to the AI features of the Service, subject to the following monthly quotas:
- 20 ATS scans per month — CV / job-offer compatibility analysis.
- 10 cover letters generated per month.
- 30 sentence rewrites per month.
- 10 profile enrichments per month (automated extraction of a CV into your structured profile, in addition to the 3 enrichments included in the free plan).
- 15 job-tailored CV generations per month. Rendering a CV from a template, without AI tailoring, is not subject to any quota.
3.2 Quota terms
Quotas reset on the first day of each calendar month (Paris time). Unused quotas do not carry over and are not refunded. Quotas are non-transferable between accounts. Any quota overrun returns an error and is not charged.
3.3 Service evolution
The Seller may evolve the features of the Service to maintain its conformity and shall notify the Customer by in-app notification or email, in the conditions set forth in article 16.
Article 4
Price
4.1 Boost subscription price
Boost is offered at the Customer's choice:
- €4.99 per month, monthly auto-renewing;
- €39 per year, yearly auto-renewing, equivalent to €3.25 per month (~35% saving compared to monthly billing).
Pursuant to article 293 B of the French General Tax Code, VAT does not apply; the listed price also corresponds to the price excluding taxes.
Mandatory mention: “TVA non applicable, art. 293 B du CGI”.
4.2 Contract price
The prices displayed on the pricing page at the time of subscription constitute the contractual price.
4.3 Price changes
The Seller may change the subscription price at any time. Any change is notified to the Customer by email with a minimum 30-day notice before taking effect. Within that period, the Customer may cancel the subscription without fee or penalty; absent cancellation, the change is deemed accepted at the end of the notice period.
Article 5
Order and contract formation
Subscription to Boost follows these steps:
- Selection of the Boost offer (monthly or yearly) on the pricing page;
- Account creation or login to an existing account;
- Entry of payment information via the provider Stripe;
- Display of an order summary detailing the offer, price, renewal terms and right of withdrawal;
- Customer's validation of the “I accept the Terms” non-pre-checked checkbox;
- Payment confirmation and confirmation email sent to the address on file.
The contract is formed upon the cumulative receipt of the payment validated by Stripe and the confirmation email sent to the Customer. The confirmation email serves as a summary on durable medium within the meaning of article L221-13 of the French Consumer Code. The Customer declares being of full age (18 years or older) and having legal capacity to subscribe.
Article 6
Payment
Payment is made exclusively by bank card (CB, Visa, Mastercard) or electronic wallet (Apple Pay, Google Pay), where available, via the payment provider Stripe Payments Europe Ltd (Ireland). The Seller does not collect or store any banking data; payment data is collected and processed directly by Stripe, acting as a data controller for that data. Stripe is PCI-DSS Level 1 certified.
Boost is charged in advance on the subscription date and then on each renewal date (monthly or yearly depending on the chosen plan). On payment failure, Stripe runs 3 retries over a 7-day period. After that, absent successful payment, Boost is automatically suspended: the Customer's account reverts to the free plan. Data and history are retained according to the Privacy Policy. The Customer can reactivate the subscription at any time by updating the payment method.
Article 7
Duration and tacit renewal
Boost is subscribed for an initial term of one month (monthly plan) or one year (yearly plan), starting on the payment date.
Pursuant to article L215-1 of the French Consumer Code, the Seller informs the Customer that the subscription renews tacitly at each due date unless cancelled by the Customer under article 9. The Customer may, at any time, cancel without fee or penalty from their personal area; cancellation takes effect at the end of the current period.
For yearly subscriptions, the Seller informs the Customer, at the earliest three months and at the latest one month before the term, of the possibility of non-renewal. For monthly subscriptions, this information is provided at subscription time and remains accessible at all times in the personal area. Absent cancellation, the subscription tacitly renews for a new identical period at the price then in force.
Article 8
Right of withdrawal
Pursuant to article L221-18 of the French Consumer Code, the Customer has a fourteen (14) day period from contract conclusion to exercise their right of withdrawal, without justification or additional cost.
The Service being digital content not provided on a tangible medium, the Customer may request immediate performance of the Service before the end of the 14-day withdrawal period. In that case, pursuant to article L221-28 13° of the French Consumer Code, the Customer expressly gives prior consent to immediate performance, expressly waives their right of withdrawal, and acknowledges losing it once performance has started with that express consent and waiver.
This double manifestation of will is collected at payment time via a dedicated, clear, non-pre-checked checkbox:
“I request immediate performance of the Boost Service and expressly acknowledge waiving my 14-day right of withdrawal, pursuant to article L221-28 13° of the French Consumer Code.”
The Seller confirms this waiver on the order summary and in the confirmation email, on a durable medium.
Absent express waiver, the Customer may exercise the right of withdrawal within 14 days by any unambiguous statement, sent by email to contact@implikare.com, by postal mail to the Seller, or by using the withdrawal form in the annex. In case of valid withdrawal, the Seller refunds the full amounts paid, using the same payment method, within a maximum of 14 days from the receipt of the withdrawal request. Pursuant to article L221-22 of the French Consumer Code, the burden of proof of the exercise of the right of withdrawal lies with the Customer.
Article 9
Cancellation
The Customer may cancel Boost at any time, without reason or notice, from their personal area (“Subscription” section). Cancellation takes effect at the end of the current period; the Customer retains access to Boost until that date. No pro-rata refund is due in case of Customer-initiated cancellation, except in case of valid withdrawal under article 8.
The Seller may cancel the subscription with 30 days' notice by email, without specific reason. The Seller may terminate the contract immediately and without notice for serious breach by the Customer, including: fraud, identity theft, fraudulent payment; violation of the Terms of Service; use contrary to public order, law or third-party rights; quota circumvention or unauthorized automated use. In case of termination for serious breach, the Seller refunds pro-rata the unused days of the current period, except where the breach constitutes fraud.
Article 10
Legal conformity guarantee for digital content
Pursuant to articles L224-25-12 and following of the French Consumer Code (transposition of EU Directive 2019/770), the Seller provides a Service that conforms to the contract and is liable for defects of conformity existing at the time of delivery and appearing within two (2) yearsof delivery. In case of defect, the Customer is entitled to free conformity remediation within a reasonable time. Failing that, the Customer may claim a price reduction or contract termination, under articles L224-25-19 and following. The Seller provides the Customer with updates, including security updates, necessary to maintain the Service's conformity throughout the contract.
Article 11
Liability
The Service is a job-search assistance tool. It is neither personalized professional advice, nor a placement service, nor a recruitment agency. The Seller does not guarantee any result regarding interviews, job offers or employment.
AI-generated content (cover letters, rewrites, scans, profile enrichments, CV generations) is produced by AI models and may contain errors, omissions or approximations. The Customer remains responsible for reviewing, correcting and using such content before any external dissemination.
To the extent permitted by law, the Seller's liability, across all causes combined, is capped at the amounts effectively paid by the Customer under the Boost subscription over the twelve (12) months preceding the triggering event. Indirect damages, loss of chance, loss of job opportunity, data loss (save Seller's default), reputational and commercial damages are excluded. These caps and exclusions do not apply in case of gross negligence, fraud, or bodily injury.
Article 12
Personal data
Processing of personal data is governed by the Privacy Policy, under GDPR (EU 2016/679) and Law 78-17 of 6 January 1978 as amended. Stripe acts as a separate data controller for payment data.
Article 13
Customer service and complaints
Any question, request or complaint may be sent to the Seller by email at contact@implikare.com or by postal mail to: Iliès Mahoudeau, 8 rue Georges Lechartier, 35700 Rennes, France. The Seller commits to responding within 5 business days.
Article 14
Governing law and jurisdiction
These Terms are governed by French law. The parties shall first seek an amicable resolution. Failing that, pursuant to article R631-3 of the French Consumer Code, the consumer Customer may bring the matter, at their option, before any court territorially competent under the Code of Civil Procedure, or before the court of the place where the consumer was residing at contract formation, or where the harmful event occurred.
Article 15
Changes to the Terms
The Seller reserves the right to amend these Terms at any time. Any substantial change is notified by email with 30 days' notice. A Customer who refuses the new Terms may cancel without fee within the notice period; absent cancellation, the new Terms are deemed accepted. The version applicable to an order is the one in force at subscription time, archived by the Seller and available on request.
